दिल्ली के मुख्यमंत्री अरविंद केजरीवाल को उच्च न्यायालय से मंगलवार को बहुत बड़ा झटका लगा है| अरविंद केजरीवाल की गिरफ्तारी और रिमांड के विरुद्ध दाखिल याचिका को दिल्ली हाईकोर्ट नें खारिज कर दिया है| अदालत ने अपने आदेश में कहा कि उनकी गिरफ्तारी कानून का उल्लंघन नहीं है| इस फैसले के बाद अरविंद केजरीवाल फिलहाल जेल में ही रहेंगे|

न्यायमूर्ति स्वर्ण कांत शर्मा की पीठ ने अपने फैसले में कहा कि प्रवर्तन निदेशालय (ईडी) के पास अरविंद केजरीवाल की गिरफ्तारी के लिए पर्याप्त आधार मौजूद हैं| पीठ नें यह भी कहा कि विशेष अदालत द्वारा केजरीवाल को रिमांड पर देना भी कानून सम्मत है| पीठ ने कहा कि यह सिर्फ केजरीवाल की गिरफ्तारी और रिमांड का मामला नहीं है, बल्कि यह आम आदमी के लिए कानूनी प्रावधान को समझने का मसला भी है| इसीलिए पीठ विस्तृत तौर पर कानूनी पक्ष को स्पष्ट कर रही है| मुख्यमंत्री अरविंद केजरीवाल की तरफ से जिन आधारों पर गिरफ्तारी और रिमांड के विरोध किया गया, वह आधारहीन है|

पीठ ने कहा कि ईडी द्वारा एकत्र की गई सामग्री से पता चलता है कि अरविंद केजरीवाल ने साजिश रची थी| वह अपराध की आय के उपयोग को छिपाने में सक्रिय रूप से शामिल थे| ईडी की जांच से यह भी पता चलता है कि वह आम आदमी पार्टी के संयोजक के तौर पर इन सब में शामिल थे| ईडी द्वारा गिरफ्तारी कानूनी तौर पर एकदम उचित है| पीठ ने जोर दिया कि कानून सभी पर समान रूप से लागू होता है| अदालतें संवैधानिक नैतिकता से जुड़ी होती हैं, ना कि राजनीतिक नैतिकता से| इसीलिए केजरीवाल की याचिका को खारिज किया जाता है

केजरीवाल के वकील ने दलील देते हुए कहा कि लोकसभा चुनाव की घोषणा के दिन उन्हें गिरफ्तार किया गया, ताकि वह चुनाव का हिस्सा न बन सके|

ईडी के पास पर्याप्त साक्ष्य

दिल्ली हाई कोर्ट ने कहा कि ईडी के पास आरोपों को लेकर प्रथम दृष्टया पर्याप्त साक्ष्य हैं| कानून सभी के लिए एक समान रूप से लागू होता है| केजरीवाल के राजनेता होने का मतलब यह नहीं है कि एक आरोपी का नाम सामने आ जाने के बाद उसे महज इस लिए बाहर रखा जाए कि वह लोकसभा या अन्य चुनाव का हिस्सा बन सके| कानून में व्यक्ति विशेष के लिए कोई विशेषाधिकार नहीं है| यदि साक्ष्य है तो कोई भी समय हो, आरोपी की गिरफ्तारी होगी|

परेशान करना उद्देश्य

केजरीवाल की ओर से दलील दी गई कि केंद्र ने जानबूझ कर उन्हें धन संशोधन में फसाया है जबकि उनके खिलाफ साक्ष्य नहीं है| सारा मकसद इस समय पर परेशान करना है|

केंद्र सरकार की भूमिका नहीं

हाईकोर्ट ने कहा यह मामला केंद्र और केजरीवाल के बीच का नहीं बल्कि अरविंद केजरीवाल और ईडी के बीच का है| इसमें केंद्र सरकार की कोई भूमिका नहीं है| जांच एजेंसी अपना काम कर रही हैं|

अदालत की टिप्पणी: आरोपी तय नहीं करेगा की जांच किस तरह की जाए, जांच आरोपी की सुविधा के मुताबिक नहीं की जा सकती है|

गिरफ्तारी से लेकर अब तक क्या हुआ?

21 मार्च को ईडी ने मुख्यमंत्री केजरीवाल को गिरफ्तार किया, और उसी दिन केजरीवाल ने सुप्रीम कोर्ट में याचिका लगाई मगर अगले दिन उसे वापस ले लिया| 22 मार्च को राउज एवेन्यू कोर्ट ने केजरीवाल को ईडी की रिमांड पर भेज दिया| 23 मार्च को मुख्यमंत्री दिल्ली हाईकोर्ट गए| 1 अप्रैल को कोर्ट ने मुख्यमंत्री अरविन्द केजरीवाल को 15 अप्रैल तक न्यायिक हिरासत में तिहाड़ जेल भेज दिया| 3 अप्रैल को हाईकोर्ट ने केजरीवाल की याचिका पर सुनवाई पूरी, अदालत ने निर्णय सुरक्षित रखा|

Delhi Chief Minister Arvind Kejriwal got a big blow from the High Court on Tuesday. The Delhi High Court has rejected the petition filed against Kejriwal’s arrest and remand. The court said in its order that his arrest is not a violation of the law. After this decision, Arvind Kejriwal will remain in jail for the time being.

The bench of Justice Swaran Kant Sharma said in its decision that the Enforcement Directorate (ED) has sufficient grounds for the arrest of Arvind Kejriwal. The bench also said that giving Arvind Kejriwal remand by the special court is also legal. The bench said that this is not just a matter of arrest and remand for Arvind Kejriwal; it is also an issue of understanding the legal provisions for the common man. That is why the bench is clarifying the legal side in detail. The grounds on which Chief Minister Arvind Kejriwal opposed the arrest and remand are baseless.

The bench said that the material collected by the ED shows that Arvind Kejriwal had hatched the conspiracy. He was actively involved in concealing the use of the proceeds of crime. ED’s investigation also reveals that he was involved in all this as the convenor of Aam Aadmi Party. The arrest by ED is absolutely justified by law. The bench emphasized that the law applies equally to all. Courts are concerned with constitutional morality, not political morality. That’s why Kejriwal’s petition was rejected.

ED has enough evidence

The Delhi High Court said that the ED has sufficient prima facie evidence regarding the allegations. The law applies equally to everyone. Arvind Kejriwal being a politician does not mean that after the name of an accused comes out, he should be kept out just so that he can be a part of the Lok Sabha or other elections. There is no privilege for any individual under the law. If there is evidence, no matter the time, the accused will be arrested.

Purpose to harass

It was argued on Arvind Kejriwal’s behalf that the Center has deliberately implicated him in the money amendment issue even though there is no evidence against him. The whole purpose is to create trouble at this time.

No role of central government

The High Court said that this matter is not between the Center and Kejriwal but between Arvind Kejriwal and ED. The central government has no role in this. The investigating agency is doing its work.

What happened since the arrest until now?

On March 21, ED arrested Chief Minister Arvind Kejriwal, and on the same day, Kejriwal filed a petition in the Supreme Court but withdrew it the next day. On March 22, Rouse Avenue Court sent Kejriwal on ED remand. On March 23, the Chief Minister went to the Delhi High Court. On April 1, the court sent Chief Minister Arvind Kejriwal to Tihar Jail in judicial custody until April 15. On April 3, after the High Court completed the hearing on Kejriwal’s petition, the court reserved the decision.

Sanjay Singh is now out of jail and is alleging that continuous pressure was put on Andhra Pradesh’s ruling party, YSR Congress MP Magunta Srinivasulu Reddy, to give a false statement against Arvind Kejriwal, and when he denied this, his son Raghava Reddy was arrested.
